The direct-distribution and Mac App Store versions use different purchasing and licensing systems. Those differences are described below. If a future update materially changes how personal information is collected, used, stored, or disclosed, this Privacy Policy will be updated accordingly. ### 02PRIVACY AT A GLANCE Fuse Caption Studio is designed so that your creative work stays on your Mac. Your imported video and audio, captions, transcripts, caption timing and styling, notes, project files, and Apple Intelligence conversations are not uploaded to Fuse Labs. Fuse Caption Studio contains no advertising SDKs, third-party analytics SDKs, behavioral tracking technologies, or developer-operated user accounts. Transcription, speaker processing, language detection, translation, and Apple Intelligence features are performed on the user's Mac using local models and Apple system frameworks. Fuse Labs does not sell personal information. Fuse Labs does not use personal information for cross-context behavioral advertising, build advertising profiles from Fuse Caption Studio activity, or track your activity across other companies' apps or websites. Certain limited network connections are necessary for functions such as downloading transcription models, purchasing and validating direct licenses, and interacting with Apple services. These are described below. ### 03INFORMATION FUSE CAPTION STUDIO DOES NOT SEND TO FUSE LABS Fuse Caption Studio does not send imported video or audio, extracted audio, transcripts, captions or subtitle text, caption timing or styling, translations, project notes, note attachments, Apple Intelligence prompts or responses, AI conversation history, .fuse project contents, speaker-separation results, or exported media/subtitles to Fuse Labs. Fuse Labs therefore cannot view, retrieve, restore, or delete this locally stored content on your behalf because Fuse Labs never receives it. ### 04LOCAL PROCESSING #### 4.1 Transcription Speech-to-text transcription is performed on your Mac. Depending on the model selected by you or automatically selected by Fuse Caption Studio, transcription may use Apple's on-device Speech framework, OpenAI Whisper model weights running locally through WhisperKit, or NVIDIA Parakeet models running locally through FluidAudio. Use of OpenAI Whisper model weights does not cause your media, audio, or transcript to be sent to OpenAI. Fuse Caption Studio does not use the OpenAI API. Parakeet transcription likewise runs locally and does not send your media to NVIDIA. #### 4.2 Apple Speech On supported versions of macOS, Fuse Caption Studio uses Apple's SpeechAnalyzer and SpeechTranscriber technologies. Speech processing through this implementation runs on device. Required speech models may be downloaded and managed by macOS. Imported audio is not sent by Fuse Caption Studio to an Apple speech-recognition server for transcription. Fuse Caption Studio may request the macOS Speech Recognition permission when necessary to use Apple's on-device speech technology. #### 4.3 Translation Fuse Caption Studio uses Apple's Translation framework. Translation is performed on device using language resources managed by macOS. macOS may download required language packs from Apple. Fuse Caption Studio does not send caption, transcript, or note text to Fuse Labs, Lemon Squeezy, Cloudflare, GitHub, Hugging Face, or another third-party translation service. #### 4.4 Apple Intelligence Fuse Caption Studio uses Apple's on-device Foundation Models framework for Apple Intelligence features, including applicable intelligent suggestions, enhanced search, summaries, note assistance, chapters, titles, hashtags, social-media text, proofreading, and commands or assistance within Fuse Caption Studio. Fuse Caption Studio does not use OpenAI, Anthropic, Google Gemini, or another cloud AI API for these features. When you intentionally request an Apple Intelligence feature, Fuse Caption Studio may provide relevant locally stored text to Apple's on-device model. For example, if you ask Fuse Caption Studio to summarize a video, it may provide captions from the timeline to the on-device model. It does not provide the underlying video or audio for this purpose. Files attached to notes are not automatically opened, executed, or read by Apple Intelligence. Apple Intelligence may work with note text when you intentionally request an applicable feature, but it is not given access to an attached file's contents. Apple Intelligence availability and operation depend on compatible Apple hardware, macOS, language and regional availability, and Apple Intelligence being enabled. Apple's terms and privacy practices apply to Apple's system technologies. ### 05DATA STORED LOCALLY ON YOUR MAC Fuse Caption Studio may store locally: .fuse projects in locations you choose; captions, timing, design settings, caption positions and project settings; project notes; Apple Intelligence Assistant conversation history associated with a project; copies of files manually attached to notes; app preferences and interface settings; selected models and languages; downloaded transcription models; security-scoped bookmarks; recent-project information; and, in the direct version, licensing and trial information. This information is not automatically transmitted to Fuse Labs. ### 06.FUSE PROJECT FILES AND SHARING A .fuse project may contain captions, timing, design settings, caption positions, project notes, Apple Intelligence Assistant conversation history, and copies of files attached to notes. It may also contain a security-scoped bookmark to the original media file and its original file path. If you manually share a .fuse project, information embedded in that project may therefore be shared with the recipient. Fuse Labs does not automatically receive a copy when you create, open, save, or share a project. ### 07FILE ACCESS AND MACOS SANDBOXING Fuse Caption Studio is sandboxed by macOS. It accesses files you intentionally select to open, import, save, or attach. Fuse Caption Studio may remember access using macOS security-scoped bookmarks. Bookmarks may be stored in app preferences for recent projects, inside a .fuse project for its original media file, and in app preferences for converted media. Fuse Caption Studio bookmarks individual files selected by the user, not entire folders. Fuse Caption Studio does not record from your microphone or camera. It does not request access to your Contacts, Calendars, location, or Photos library, and it does not request blanket access to your Desktop, Documents, or Downloads folders. It processes media that you choose to import. ### 08NOTES AND ATTACHMENTS Files attached to notes are copied into local resources associated with the .fuse project and are not uploaded to Fuse Labs. Because attachments may be included when a .fuse project is shared, you should review a project before sharing it if it contains private or confidential attachments. ### 09DIRECT-VERSION PRO TRIAL The direct-distribution version may provide a time-limited Pro trial. Trial enforcement is entirely local and makes no network requests. The trial record contains exactly the first-launch date, trial start date, seconds of trial time used, whether the trial has finished, and whether the trial-end notice has been shown. It contains no hardware fingerprint, serial number, MAC address, hardware UUID, IP address, Apple Account, or other hardware identifier. The record is signed locally and stored in the macOS Keychain, Application Support, and app preferences to enforce the one-trial rule. None of this trial information is transmitted to Fuse Labs or a third party. This trial system is not included in the Mac App Store version. ### 10DIRECT LICENSE ACTIVATION AND VALIDATION This section applies only to Fuse Caption Studio obtained directly from Fuse Labs. After purchase, Fuse Caption Studio uses Lemon Squeezy's licensing services to activate and periodically validate the license. Activation sends the license key and a device instance label in the format: “Fuse Caption Studio · · ” Example: “Fuse Caption Studio · Mac Studio (2023) · 7F3A” The Mac model name is the marketing model name reported by macOS when available, or a short Apple model identifier otherwise. The four-character tag is generated randomly once and stored locally so the same Mac continues using the same label. The label does not contain your name, Mac computer/network name, serial number, hardware UUID, MAC address, IP address, or Apple Account. Lemon Squeezy returns an activation instance ID, which Fuse Caption Studio stores locally and uses for subsequent validation and deactivation. The purpose is to activate, validate and deactivate licenses and distinguish the Macs on which a license is active. Fuse Caption Studio normally revalidates a direct license approximately once every 24 hours while running. If validation cannot occur while offline, Pro continues for a limited period before a successful validation is required. The license key, activation ID, plan, expiry, last-validation date, and a local tamper-check signature are stored in Fuse Caption Studio's local preferences. The license key is not stored in Keychain. ### 11DIRECT PURCHASES AND LEMON SQUEEZY Direct purchases are processed by Lemon Squeezy as Merchant of Record. Lemon Squeezy handles checkout, payment processing, applicable sales taxes/VAT, invoices, refunds, and related transaction administration. Payment credentials such as full payment-card information are processed by Lemon Squeezy or the applicable payment provider. Fuse Caption Studio and Fuse Labs do not receive or process full payment-card credentials. Lemon Squeezy may collect information such as name, email address, billing information, country, payment method and order information as necessary to administer a purchase. Lemon Squeezy's own privacy policy governs its processing. Fuse Labs can access certain customer and transaction information made available through Lemon Squeezy's merchant tools when needed to administer purchases, licenses, refunds, billing questions and support. Fuse Labs does not use direct-purchase information for behavioral advertising or unrelated marketing. Purchasing does not automatically enroll you in a Fuse Labs marketing mailing list. Purchase-related communications may be sent when necessary to administer a transaction, license, subscription, refund, or related matter. Lemon Squeezy may retain transaction records after a refund, cancellation, or expiration according to its own legal, financial, and privacy obligations. ### 12DIRECT CHECKOUT INSIDE FUSE CAPTION STUDIO The direct version may display Lemon Squeezy checkout in a non-persistent in-app web view. Fuse Caption Studio does not read, inspect, record, or intercept information typed into checkout fields. It receives only a fixed checkout-success signal to determine that checkout completed. Order details broadcast by the checkout page are not passed through to Fuse Caption Studio. The app may also observe navigation solely to detect the checkout success page. Some payment methods may open in your default browser. Information entered there is handled by Lemon Squeezy and/or the applicable payment provider. Fuse Caption Studio does not receive your payment credentials. ### 13CLOUDFLARE STORE SERVICE The direct version uses a Fuse Labs store service hosted on Cloudflare Workers so Fuse Caption Studio can communicate with purchase infrastructure without embedding private store credentials in the application. Lemon Squeezy webhooks may briefly pass order-related information through the Worker. The Worker does not create a permanent copy of the complete order. The temporary purchase claim stored by the Worker contains only a randomly generated claim ID, purchase status, purchased plan and license key. It does not store the purchaser's name, email address or payment details. A claim is normally deleted within seconds after Fuse Caption Studio successfully collects the license key. It is deleted immediately if the order is refunded and, if not previously deleted, automatically expires no later than 24 hours after its last update. Cloudflare may process standard network/request information such as IP address and timestamp as part of operating its infrastructure and under Cloudflare's own privacy practices. Fuse Labs has not intentionally enabled additional Worker logging, Logpush, or custom request logging for this service. ### 14MAC APP STORE PURCHASES Purchases through the Mac App Store are processed by Apple using StoreKit. Apple handles billing, subscriptions, payment information, renewals, cancellations and applicable refund processes under Apple's terms and privacy practices. Fuse Caption Studio does not receive payment-card credentials from Apple. Fuse Labs receives the sales, financial, subscription and analytics information Apple makes available to developers through App Store Connect and related developer services. Fuse Caption Studio does not receive a purchaser's name or email address through ordinary StoreKit purchases. Fuse Labs does not operate a server receiving App Store Server Notifications or purchase receipts for Fuse Caption Studio. The Mac App Store version does not contain the Lemon Squeezy client, Lemon Squeezy checkout window or direct-version trial system. It does not contact Lemon Squeezy, the Fuse Labs Cloudflare store Worker, the direct store configuration file, or the direct-version update file. ### 15NETWORK CONNECTIONS Fuse Caption Studio is primarily local but uses network access for limited functions. Model catalog: Fuse Caption Studio may retrieve a static catalog hosted through GitHub. Requests do not include project content, captions, transcript text, notes, license information or an app-generated user identifier. Model downloads: when you install or update a supported transcription model, Fuse Caption Studio downloads files directly from Hugging Face to your Mac. Downloads are not proxied through Fuse Labs. No project content is sent. Hugging Face and infrastructure providers may receive standard network information such as your IP address. Direct-version store/licensing: the direct version may connect to Lemon Squeezy and the Fuse Labs Cloudflare store service for purchasing and licensing as described above. Direct-version updates: the direct version may retrieve a static version file hosted through GitHub when update checking is enabled. The Mac App Store version does not use this mechanism. Apple services: Fuse Caption Studio may communicate with Apple, or cause macOS to communicate with Apple, for StoreKit and Apple-managed speech, translation, and Apple Intelligence resources. Apple's privacy practices apply. These connections are not used by Fuse Labs to receive your imported media, captions, transcripts, project notes or Apple Intelligence conversations. ### 16WEBSITE PRIVACY The Fuse Caption Studio website uses Google Analytics to understand general website usage and improve the website. Google Analytics is optional and does not load until you consent to analytics cookies through the website's cookie-consent mechanism. If you decline analytics cookies, Google Analytics does not load. When you consent, Google Analytics may use cookies and process browser/device information, pages visited, approximate location derived from IP address, referral information, interactions and other standard website analytics information under Google's privacy practices. Fuse Labs uses this information to understand website performance and general visitor behavior, not for cross-context behavioral advertising. Fuse Labs also uses Google Search Console to understand how the website appears and performs in Google Search. Search Console is website-owner/search-performance tooling and is not an in-app tracking technology. The website does not use an advertising network or advertising SDK. Google Analytics on the website is separate from Fuse Caption Studio itself; Fuse Caption Studio contains no Google Analytics integration. ### 17COOKIES The website displays a consent mechanism for optional analytics. Analytics cookies are used only after you consent. You may decline them and, where available through the website's controls or browser, withdraw or change consent. Cookies and related technologies used by third-party checkout/payment pages are governed by those third parties' policies. ### 18SUPPORT AND VOLUNTARILY PROVIDED INFORMATION If you contact Fuse Labs for support, Fuse Labs receives information you choose to provide, such as your email address, message, screenshots, diagnostic information, crash reports, project files or other attachments. Fuse Caption Studio includes Self-Diagnostics. Running it does not automatically transmit anything to Fuse Labs. Diagnostic information is generated locally. Fuse Caption Studio opens your default mail application and prepares a support email with the recipient and subject. Nothing reaches Fuse Labs unless you choose to send the email. If you voluntarily send a .fuse project, screenshot, log, diagnostic output or other file, Fuse Labs may access its contents to investigate and respond. Support correspondence may be retained for as long as Fuse Labs reasonably considers useful for support, maintaining context about previous issues, resolving recurring technical problems, appropriate business records, or protecting legal rights. It is not sold or used for behavioral advertising. ### 19NO ADVERTISING, APP TRACKING OR PROFILING Fuse Caption Studio contains no advertising, third-party advertising SDKs or analytics SDKs. Fuse Labs does not use Fuse Caption Studio to track you across other companies' apps or websites or build behavioral profiles from your projects, languages, models, captions, notes, AI prompts or imported media. Fuse Labs does not sell personal information and does not share personal information for cross-context behavioral advertising. Optional Google Analytics on the website is described separately and does not operate inside Fuse Caption Studio. ### 20CRASH REPORTING AND TELEMETRY Fuse Caption Studio contains no developer-operated analytics, telemetry, or automatic crash-reporting service and does not automatically send crash reports to Fuse Labs. Apple may independently process diagnostics or analytics at the operating-system/App Store level according to your Apple settings and Apple's privacy practices. That is separate from Fuse Caption Studio's own practices. Crash reports or diagnostics voluntarily sent to Fuse Labs are treated as support information. ### 21THIRD-PARTY SERVICES Depending on how you obtain and use Fuse Caption Studio, relevant providers may include: Apple Inc.: Mac App Store distribution/payments, StoreKit, macOS system frameworks, Apple-managed model/language downloads, Apple Speech, Apple Translation and Apple Intelligence. Lemon Squeezy: Merchant of Record, payment/billing and license processing for direct distribution. Cloudflare: hosting of the Fuse Labs direct-store Worker and temporary purchase claims. GitHub: static configuration including the model catalog and, for direct distribution, applicable store/update configuration. Hugging Face: hosting downloadable transcription model files. Google: consent-based Google Analytics on the Fuse Caption Studio website and Google Search Console. These providers operate under their own terms and privacy policies. Information available to each depends on the service being used. ### 22DATA RETENTION Most Fuse Caption Studio data remains on your Mac, so Fuse Labs does not establish a server-side retention period for your projects, media, transcripts, captions, notes, AI conversations or downloaded models. You control how long local projects and related data remain. For direct distribution, temporary Cloudflare purchase claims normally disappear within seconds and automatically expire no later than 24 hours after the last update; local trial data remains to enforce the one-trial rule; local licensing data remains as needed to maintain/validate the license; and Lemon Squeezy retains transaction/licensing records according to its obligations. Support communications are retained for as long as reasonably useful for support history, troubleshooting, business records, dispute resolution, security or legal obligations. Website analytics information is retained according to Fuse Labs' Google Analytics configuration and Google's applicable policies. ### 23DELETING LOCAL DATA Fuse Labs cannot remotely delete information that exists only on your Mac because Fuse Labs does not possess it. You can remove local data by deleting .fuse project files and exports, removing downloaded models through Fuse Caption Studio's model-management features where available, uninstalling Fuse Caption Studio, and removing associated Application Support files and preferences if you wish to remove remaining app data. Some information may exist in Keychain or other macOS-managed locations, particularly direct-version trial information. Deleting or reinstalling Fuse Caption Studio does not necessarily reset eligibility for a direct-version trial. ### 24SECURITY Fuse Labs uses reasonable technical and organizational measures appropriate to the limited information it handles. Fuse Caption Studio's architecture reduces exposure by keeping creative content and AI processing on the user's Mac rather than maintaining a Fuse Labs cloud repository for user projects. No method of electronic storage, internet transmission or third-party service can be guaranteed completely secure. Users are responsible for protecting their Macs, project files, license keys, email accounts and project copies they choose to share. ### 25CHILDREN'S PRIVACY Fuse Caption Studio is a general-purpose creative application, not a social network or behavioral advertising service. It does not operate user accounts, social features, public profiles or user-to-user communication, and Fuse Labs does not knowingly use the application to collect children's project content. Where a child or minor uses Fuse Caption Studio, a parent, guardian, school or other responsible adult should supervise use where required by applicable law. Purchases through Apple or Lemon Squeezy remain subject to those providers' terms, account requirements and age requirements. ### 26INTERNATIONAL AVAILABILITY AND DATA TRANSFERS Fuse Caption Studio may be available worldwide where distribution and purchasing services permit. Fuse Labs is located in Ontario, Canada. Providers including Apple, Lemon Squeezy, Cloudflare, GitHub, Hugging Face and Google may process limited information in Canada, the United States, the European Economic Area, the United Kingdom or other jurisdictions where they or their providers operate. Limited information associated with purchases, website analytics, network requests or support may therefore be processed outside your country and subject to local law. Your locally stored Fuse Caption Studio projects and creative content are not transferred internationally by Fuse Labs because Fuse Labs does not receive them. ### 27YOUR PRIVACY RIGHTS Depending on your location and the information Fuse Labs holds, you may have rights to request access, correction, deletion/erasure, restriction, objection, portability, withdrawal of consent where applicable, and to complain to an applicable privacy/data-protection authority. Rights are subject to applicable law, exemptions, verification requirements, and lawful retention needs. Because Fuse Labs does not receive locally stored projects, media, captions, transcripts, notes or AI conversations, Fuse Labs cannot provide, correct or delete that local content on your behalf. ### 28CANADA Fuse Labs is based in Ontario, Canada. Where Canadian privacy law applies, Fuse Labs handles personal information in accordance with applicable Canadian privacy requirements, including principles concerning accountability, appropriate purposes, consent where required, limiting collection/use, safeguards, access and correction. Privacy requests may be sent to [support@fuselabssoftware.com](mailto:support@fuselabssoftware.com) . ### 29EUROPEAN ECONOMIC AREA AND UNITED KINGDOM If you are in the EEA or UK, applicable law may provide rights including access, rectification, erasure, restriction, portability, objection and withdrawal of consent. Depending on context, limited processing may rely on performance of a contract (for example, administering a direct purchase/license), legitimate interests (such as support, abuse prevention and appropriate business records), consent (such as optional website analytics), or compliance with legal obligations. Where processing is based on consent, withdrawal does not affect processing lawfully performed before withdrawal. Where applicable, you may complain to the data-protection authority in your country. Fuse Labs does not use automated decision-making through Fuse Caption Studio that produces legal or similarly significant effects based on profiling. ### 30UNITED STATES AND CALIFORNIA Residents of certain U.S. states may have applicable rights to know/access, correct, delete or obtain a portable copy of certain personal information and opt out of certain uses. Fuse Labs does not sell personal information. Fuse Labs does not share personal information for cross-context behavioral advertising. Fuse Labs does not use Fuse Caption Studio for targeted advertising or process sensitive personal information for the purpose of inferring characteristics about users. Because creative content remains local, Fuse Labs generally does not possess media, projects, transcripts, captions, notes or AI conversations created in Fuse Caption Studio. ### 31PRIVACY REQUESTS AND IDENTITY VERIFICATION To make a privacy request, contact [support@fuselabssoftware.com](mailto:support@fuselabssoftware.com) . Fuse Labs may verify that a request relates to the person making it before disclosing, correcting or deleting personal information. For a direct-purchase request, Fuse Labs may ask for a purchase receipt. If unavailable, Fuse Labs may request sufficient purchase information to locate and verify the record, such as purchasing email address, purchaser name and approximate order date. Only information reasonably necessary to verify and fulfill the request will be requested. If requested information exists only locally on your Mac and was never received by Fuse Labs, Fuse Labs will explain that it does not possess it and cannot retrieve or delete it remotely. ### 32PURCHASE RECORD DELETION Some transaction records cannot necessarily be deleted immediately upon request. Apple, Lemon Squeezy, payment providers and Fuse Labs may be required or permitted to retain certain transaction information for accounting, tax, fraud prevention, chargebacks, contractual, regulatory or other legal purposes. Where Fuse Labs receives a valid deletion request, it will delete or de-identify information under its control when required by applicable law and when no lawful retention requirement or exception applies. ### 33DO NOT SELL OR SHARE Fuse Labs does not sell personal information and does not share personal information for cross-context behavioral advertising. Fuse Labs does not operate an advertising business based on Fuse Caption Studio user information. Accordingly, Fuse Caption Studio does not provide an in-app “Do Not Sell or Share My Personal Information” mechanism because it does not engage in those practices.
